Terms of Use

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not use the Service. If you use the Service on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.

Casita is a marketplace that helps people who have an efficiency, studio, room, or similar unit to rent connect and communicate with people looking for one. Casita is a venue and communication platform only.

Casita is not a landlord, a real estate broker or agent, a property manager, an escrow agent, or a party to any rental, lease, payment, or other agreement between users. We do not own, manage, inspect, endorse, or guarantee any property, and we do not verify the legal, zoning, occupancy, safety, or permit status of any unit. Any rental, deposit, payment, tour, or move-in is arranged solely between the owner and the renter, at their own risk.

You are responsible for the information you provide and for all activity under your account. Keep your login credentials secure and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms. You can delete your account and associated data at any time from the Account tab in the app.

To reduce fraud, we may verify a user’s identity (for example, with a government ID and a selfie) and, for owners, may check public records to confirm a listing corresponds to a real person who controls the property. Verification badges state exactly what was checked.

Verification reduces the risk of impersonation and fake listings. It is not a guarantee about any person, any property, its condition, or its legality, and you should continue to use your own judgment and ordinary caution.

• Post only accurate, current, and non-misleading listings.
• List only property you own or are lawfully authorized to rent, and comply with all applicable laws, including landlord-tenant, building, occupancy, zoning, licensing, tax, and fair housing laws.
• You are solely responsible for the legality of what you list and for your dealings with renters. Casita does not verify permit or zoning status and is not responsible for it.

• Provide accurate information about yourself and your search.
• Communicate honestly and treat owners and other users with respect.
• Use your own judgment. Never send money, deposits, or sensitive information to anyone you have not met and verified independently.

Casita is committed to fair housing. You agree not to express, on the Service, any preference, limitation, or discrimination based on race, color, religion, sex, gender identity, sexual orientation, national origin, familial status, disability, or any other class protected by federal, state, or local law, and not to take any action that violates fair housing laws. We may remove content and accounts that do.

Browsing listings and showing interest are free for renters. An owner may pay a fee to unlock messaging with an interested, verified renter. The fee is for a real-world connection service, is disclosed before you pay, and is not a security deposit and is not held in escrow.

Except as required by law or as expressly stated at the time of purchase, fees are non-refundable. Payments are processed by third-party payment processors subject to their terms; you authorize us and our processors to charge your selected payment method.

You retain ownership of the content you submit (listings, photos, messages, and other materials). You grant Casita a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and use that content as needed to operate, improve, and promote the Service. You represent that you have the rights to the content you submit and that it does not violate any law or third-party right.

There is zero tolerance for objectionable content or abusive behavior on Casita. You agree not to:

• Post or send content that is unlawful, fraudulent, false, harassing, threatening, hateful, discriminatory, defamatory, or sexually explicit;
• Post fake, duplicate, or bait listings, or impersonate any person or entity;
• Harass, abuse, harm, stalk, or intimidate another user, or solicit personal or financial information under false pretenses;
• Scrape, harvest, reverse engineer, overload, or interfere with the Service, or attempt to bypass verification, fees, or security;
• Use the Service for any unlawful or unauthorized purpose.

You can report any listing or message and block any user from inside the app. We review every report and will remove content and eject users who violate these Terms, typically within 24 hours of a report. Violations may result in immediate suspension or termination without notice.

The Service relies on third parties (for example, cloud hosting, identity verification, mapping, and payment processing). We are not responsible for third-party services, and your use of them may be subject to their own terms.

The Service, including its software, design, logos, and content (excluding user content), is owned by Casita and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works except as allowed by these Terms.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any listing, user, or property is accurate, legal, safe, or suitable. Casita is not responsible for the conduct of any user, online or offline.

TO THE FULLEST EXTENT PERMITTED BY LAW, CASITA AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR THE CONDUCT, CONDITION, SAFETY, OR LEGALITY OF ANY USER OR PROPERTY, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.

(a) Informal resolution first. Before starting an arbitration, you agree to first try to resolve the dispute informally by emailing hello@casita.app with a description of the dispute and the relief you seek. We will try in good faith to resolve it within 30 days. If we cannot, either party may begin arbitration.

(b) Binding arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitrator will decide all issues, except that a court may decide whether this arbitration agreement is enforceable. Judgment on the award may be entered in any court with jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.

(c) Class action waiver.You and Casita agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any class or representative proceeding. If this class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and may proceed in court.

(d) 30-day right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hello@casita.app with your name and a clear statement that you opt out of arbitration. Opting out will not affect any other part of these Terms.

(e) Small claims and injunctions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property or stop unauthorized use of the Service.

(f) Governing law and venue. These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. To the extent any dispute is not subject to arbitration, it will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.

You agree to indemnify and hold harmless Casita and its owners, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, your dealings with other users, or your violation of these Terms or any law.

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, provide notice in the app. Your continued use of the Service after changes take effect means you accept the revised Terms.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms or to protect the Service or its users. Sections that by their nature should survive termination (including Sections 9 through 17) will survive.

These Terms, together with the Privacy Policy, are the entire agreement between you and Casita regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
